BY DOWNLOADING, ACCESSING, OR USING GIOMIND, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THIS SERVICE.

THIS AGREEMENT CONTAINS IMPORTANT LIMITATIONS ON LIABILITY, DISCLAIMERS OF WARRANTIES, AND REQUIRES BINDING ARBITRATION OF DISPUTES.

1. INTRODUCTION & ACCEPTANCE OF TERMS

1.1 Agreement to Terms

By downloading, installing, accessing, or using GioMind (the "App", "Service", "Application", or "Platform"), you:

• Confirm you have read, understood, and agree to these Terms of Use ("Terms", "Agreement")

• Agree to be legally bound by this Agreement

• Confirm you are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher)

• Understand that GioMind uses third-party artificial intelligence systems

• Accept all risks associated with using AI-generated content

• Waive any claims against GioMind to the maximum extent permitted by law

1.2 Legal Capacity

You represent and warrant that:

• You have the legal capacity to enter into binding contracts

• You are not prohibited by law from using this Service

• All information you provide is accurate and truthful

• You will comply with all applicable local, national, and international laws

1.3 If You Disagree

If you do not agree to these Terms, you must immediately:

• Stop using the Service

• Uninstall the Application

• Delete your account (if created)

2. ABOUT GIOMIND & NATURE OF THE SERVICE

2.1 Service Description

GioMind is a digital wellness, mindfulness, and self-help support application designed for general well-being purposes only.

The Service provides:

• Guided meditation sessions

• Breathing exercises and techniques

• Relaxation programs and soundscapes

• Mood tracking and journaling tools

• AI-powered conversational wellness support

• Educational content about mindfulness and well-being

• Daily reminders and motivational content

2.2 Platform Availability

GioMind is currently available exclusively on:

• iOS (iPhone and iPad)

• Through the Apple App Store

The Service is not available on Android, web, or any other platforms.

2.3 What GioMind IS NOT

GioMind is NOT and does not provide:

❌ Medical treatment, advice, or services

❌ Psychiatric evaluation or care

❌ Psychological therapy or counseling

❌ Clinical mental health services

❌ Diagnosis of any medical or mental health condition

❌ Treatment for any illness or disorder

❌ Emergency mental health services

❌ Crisis intervention

❌ Suicide prevention services

❌ Professional healthcare of any kind

❌ A replacement for licensed medical professionals

2.4 Service Purpose

The Service is intended ONLY for:

• General wellness support

• Relaxation and stress reduction

• Mindfulness practice

• Self-reflection and personal growth

• Educational purposes

3. AI-GENERATED CONTENT & COMPREHENSIVE DISCLAIMER

3.1 Third-Party AI Systems

GioMind uses artificial intelligence technology provided by third-party companies, including but not limited to:

• OpenAI (GPT models and variations)

• Anthropic (Claude AI models)

• Other AI service providers (current and future)

3.2 Nature of AI-Generated Content

You expressly understand and agree that:

• AI responses are AUTOMATICALLY GENERATED by algorithms

• NO human professional reviews or approves AI responses before delivery

• AI output is NOT verified for accuracy, safety, or appropriateness

• AI may produce unpredictable, unusual, or unintended content

• AI does NOT have medical, psychological, or clinical training

• AI does NOT understand your personal medical or mental health situation

• AI cannot assess whether advice is safe or appropriate for you

3.3 AI Content Limitations & Risks

AI-generated content may be:

❌ Inaccurate or factually wrong

❌ Incomplete or missing critical information

❌ Outdated or no longer current

❌ Misleading or confusing

❌ Inconsistent across different sessions

❌ Inappropriate for your specific situation

❌ Harmful if followed or relied upon

❌ Not applicable to your jurisdiction or circumstances

❌ Based on biased or incomplete training data

3.4 Your Responsibility

You are SOLELY and ENTIRELY responsible for:

• How you interpret AI-generated content

• Any decisions you make based on AI responses

• Any actions you take after receiving AI content

• Verifying information with qualified professionals

• Assessing whether content is safe and appropriate for you

• Any consequences resulting from your use of AI content

3.5 No Warranties for AI Content

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• GioMind makes NO WARRANTIES about AI accuracy, reliability, or safety

• GioMind does NOT guarantee any specific results or outcomes

• GioMind does NOT endorse or verify AI-generated content

• GioMind CANNOT and does NOT control AI outputs

• GioMind assumes NO LIABILITY for AI responses or their consequences

3.6 AI Memory & Conversation Retention

GioMind uses an AI memory system to provide personalized responses:

WHAT IS STORED:

• Conversation history and context

• Personal information you share (name, age, preferences, health conditions, etc.)

• Goals, habits, and behavioral patterns

• Events, appointments, and reminders

3-LAYER MEMORY SYSTEM:

1. PERMANENT (Importance: 5) - Never deleted automatically

• Core identity: Name, age, profession, family status

• Health: Chronic conditions, allergies, ongoing medications

• Character traits and definite preferences

2. MEDIUM-TERM (Importance: 3-4) - Retained for 90 days

• Recent events, job changes, active projects

• Ongoing goals and temporary preferences

• Relationships and learned behavioral patterns

3. TEMPORARY (Importance: 1-2) - Retained for 7 days

• Daily status: "I am tired today", "had a meeting yesterday"

• This week's events and momentary feelings

• Non-repetitive, one-time situations

AUTOMATIC DECAY RULES:

• Information mentioned 3+ times → importance increases

• Information mentioned 15+ times → becomes PERMANENT

• Unused information after 7/90 days → automatically deleted based on importance

• Conflicting information → you will be asked to clarify

EVENT TRACKING:

• Maximum 10 events stored at any time

• Cancelled events → deleted after 90 days

• Completed events → deleted after 180 days

• Oldest events automatically removed when limit reached

EVENT LIMITATIONS & DISCLAIMERS:

• AI may create INCORRECT or INACCURATE events

• Dates, times, and details may be WRONG

• AI may FORGET to create reminders you mentioned

• AI may MISUNDERSTAND your instructions

• Events are NOT verified by humans

• You are responsible for verifying all event information

• Do NOT rely on AI for critical appointments or time-sensitive events

• Always use a proper calendar app for important events

DATA DELETION:

You can delete your AI memory data:

• Settings → Delete Account (permanently deletes ALL data including AI memory)

• Email us: giomind.app@gmail.com with deletion request

UPON ACCOUNT DELETION:

• All AI memory data deleted within 90 days

• Conversation history permanently removed

• Event data deleted

• Personal information permanently erased

• Anonymized analytics may be retained

THIRD-PARTY AI PROVIDER RETENTION:

• OpenAI: Retains data for 30 days (subject to their policy)

• Anthropic: Retention varies (subject to their policy)

• See Section 15 (Privacy & Data Protection) for details

IMPORTANT:

• AI memory is NOT reviewed by humans (except for safety concerns)

• Memory is used to personalize responses only

• You are responsible for what you share with AI

• Do NOT share sensitive information you don't want stored

• Memory system may contain errors or inaccuracies

4. ABSOLUTE PROHIBITION: NO MEDICAL OR MENTAL HEALTH USE

4.1 Critical Warning – Not a Medical Service

⚠️ GIOMIND IS NOT A MEDICAL, PSYCHIATRIC, PSYCHOLOGICAL, OR THERAPEUTIC SERVICE ⚠️

The Service is NOT a substitute for:

❌ Medical advice, diagnosis, or treatment

❌ Psychiatric evaluation or medication management

❌ Psychological counseling or psychotherapy

❌ Clinical mental health treatment

❌ Emergency mental health services

❌ Crisis intervention or suicide prevention

❌ Professional healthcare of any kind

4.2 Conditions Requiring Professional Care

GioMind is NOT designed for and NOT suitable for individuals with:

• Major depression or depressive disorders

• Bipolar disorder

• Schizophrenia or psychotic disorders

• Severe anxiety disorders

• Post-traumatic stress disorder (PTSD)

• Eating disorders

• Substance use disorders

• Suicidal ideation or self-harm tendencies

• Any diagnosed mental health condition requiring treatment

• Any medical condition affecting mental state

IF YOU HAVE ANY OF THESE CONDITIONS, DO NOT RELY ON GIOMIND.

4.3 When to Seek Professional Help

You MUST immediately contact a licensed healthcare professional if you experience:

• Thoughts of suicide or self-harm

• Thoughts of harming others

• Severe depression or hopelessness

• Psychotic symptoms (hallucinations, delusions)

• Severe anxiety or panic attacks

• Substance abuse or addiction issues

• Trauma or abuse (current or past)

• Any mental health crisis or emergency

4.5 Absolute Prohibition on Reliance

UNDER NO CIRCUMSTANCES should you:

❌ Rely on GioMind for medical or mental health decisions

❌ Use GioMind instead of seeking professional care

❌ Delay seeking professional help based on GioMind content

❌ Stop prescribed treatments based on GioMind suggestions

❌ Use GioMind during a mental health crisis or emergency

5. AGE RESTRICTIONS & PARENTAL CONSENT

5.1 Minimum Age Requirement

To use GioMind, you MUST be:

• At least 18 years old, OR

• The age of majority in your jurisdiction (whichever is higher)

Examples:

• United States: 18 years (19 in Alabama, Nebraska; 21 in Mississippi)

• European Union: 18 years (16 for some services)

• United Kingdom: 18 years

• Canada: 18-19 years (varies by province)

• Australia: 18 years

• Turkey: 18 years

5.2 Age Verification

By using GioMind, you represent and warrant that you meet the age requirement.

5.3 No Use by Minors

• GioMind does NOT knowingly collect data from anyone under 18

• GioMind is NOT designed or intended for minors

• If you are under 18, you MUST immediately stop using the Service

5.4 Parental Responsibility

If you are a parent or guardian and discover your minor child is using GioMind:

• Immediately remove the App from their device

• Contact us at giomind.app@gmail.com to delete their data

• We will delete accounts of users we discover are underage

6. ACCOUNT REGISTRATION, SECURITY & USER OBLIGATIONS

6.1 Account Creation

To access certain features, you must create an account.

You agree to:

✓ Provide accurate, complete, and current information

✓ Update your information to keep it accurate

✓ Choose a secure password

✓ Keep your login credentials confidential

✓ Not share your account with others

✓ Not use another person's account

6.2 Account Security

You are SOLELY responsible for:

• All activities that occur under your account

• Maintaining the security of your device

• Keeping your password confidential

• Any unauthorized access resulting from your negligence

• Notifying us immediately if you suspect unauthorized access

6.3 Account Termination

We reserve the right to suspend or terminate your account immediately if:

• You violate these Terms

• You provide false information

• You are under 18 years old

• You engage in prohibited conduct

• We suspect fraudulent activity

• Required by law or legal process

6.4 No Liability for Account Issues

GioMind is NOT responsible for:

❌ Losses caused by unauthorized account access

❌ Your failure to secure your device or account

❌ Password theft or data breaches on your device

❌ Account compromise due to your actions or negligence

7. SUBSCRIPTIONS, PAYMENTS & AUTOMATIC RENEWAL

7.1 Subscription Model

GioMind operates on a MONTHLY SUBSCRIPTION model.

• Subscription Type: Monthly only

• Payment Platform: Apple App Store only

• Free Trial: NOT AVAILABLE

• Payment begins immediately upon subscription

7.2 Subscription Terms

By subscribing, you agree that:

✓ You will be charged the subscription price listed in the App Store

✓ Prices may vary by country, region, and local currency

✓ Prices include applicable taxes (VAT, GST, etc.) where required

✓ Pricing may change at any time (with notice as required by law)

✓ Your subscription will automatically renew each month

7.3 Automatic Renewal

YOUR SUBSCRIPTION AUTOMATICALLY RENEWS UNLESS CANCELED.

• Renewal occurs 24 hours before the current period ends

• Your payment method will be charged automatically

• You will receive the same subscription at the then-current price

• Renewal continues until you cancel

7.4 Cancellation Policy

To cancel your subscription:

1. Open Settings on your iOS device

2. Tap your Apple ID at the top

3. Tap "Subscriptions"

4. Select GioMind

5. Tap "Cancel Subscription"

Important:

• You must cancel at least 24 hours before renewal to avoid being charged

• Cancellation takes effect at the end of the current billing period

• You retain access until the end of the paid period

• No partial refunds for unused time in the current period

7.5 Refund Policy

ALL PAYMENTS ARE PROCESSED THROUGH APPLE APP STORE.

• GioMind CANNOT issue refunds directly

• ALL refund requests must be submitted to Apple

• Refunds are subject to Apple's refund policy

• We have no control over Apple's refund decisions

To request a refund from Apple:

2. Sign in with your Apple ID

3. Find your GioMind purchase

4. Click "Report a Problem"

5. Follow Apple's instructions

7.6 Restore Purchases

If you previously purchased a subscription:

• You can restore your purchase in the App

• Tap "Restore Purchases" in Settings

• Sign in with the same Apple ID used for original purchase

7.7 Payment Processing

• All payments are processed by Apple, Inc.

• You agree to Apple's payment terms

• GioMind does NOT store or process credit card information

• Payment disputes must be directed to Apple

7.8 Price Changes

We reserve the right to change subscription prices at any time.

• Active subscribers will be notified of price changes

• Notice will be provided as required by applicable law (typically 30 days)

• Continued use after price change constitutes acceptance

• You may cancel before the price change takes effect

7.9 Subscription Limitations

❌ No free trial period

❌ No yearly or other subscription options currently available

❌ No lifetime or one-time purchase options

❌ No family sharing plans

❌ No corporate or bulk licensing

8. PROHIBITED CONDUCT & USER RESPONSIBILITIES

8.1 Strictly Prohibited Activities

You agree NOT to:

Medical/Health Misuse:

❌ Use GioMind for medical or mental health treatment

❌ Rely on AI responses for health decisions

❌ Seek diagnosis or treatment advice from the App

❌ Use the Service during mental health crises

❌ Replace professional medical care with GioMind

Technical Misuse:

❌ Reverse engineer, decompile, or disassemble the App

❌ Attempt to hack, breach, or circumvent security measures

❌ Use automated systems or bots to access the Service

❌ Scrape, copy, or extract data from the Service

❌ Interfere with or disrupt the Service or servers

❌ Introduce viruses, malware, or harmful code

Content Misuse:

❌ Upload illegal, harmful, or hateful content

❌ Harass, threaten, or abuse others

❌ Impersonate any person or entity

❌ Violate intellectual property rights

❌ Post spam or unsolicited commercial content

Account Misuse:

❌ Create multiple accounts to circumvent restrictions

❌ Share your account with others

❌ Sell or transfer your account

❌ Provide false age or identity information

Dangerous Use:

❌ Use GioMind while driving any vehicle

❌ Use GioMind while operating machinery or equipment

❌ Use GioMind in any situation requiring attention to safety

❌ Use meditation or breathing features if medically contraindicated

Legal Violations:

❌ Use the Service for any illegal purpose

❌ Violate any applicable local, national, or international law

❌ Facilitate or encourage illegal activity

8.2 Consequences of Violations

If you violate these Terms, we may:

• Immediately suspend or terminate your account

• Remove or disable access to content

• Report violations to law enforcement

• Take legal action to recover damages

• Refuse future access to the Service

8.3 No Refunds for Violations

If your account is terminated for violating these Terms:

• You are NOT entitled to any refund

• All paid subscription time is forfeited

• You remain liable for all fees owed

9. COMPREHENSIVE LIMITATION OF LIABILITY

9.1 Maximum Liability Cap

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF GIOMIND, ITS DEVELOPER, OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, PARTNERS, SUPPLIERS, AND SERVICE PROVIDERS FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE LESSER OF:

(a) The amount you paid to GioMind in the 12 months before the claim, OR

(b) $10.00 USD (ten US dollars)

This limitation applies regardless of the theory of liability, whether based on warranty, contract, statute, tort (including negligence), or any other legal theory.

9.2 Excluded Liability Categories

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIOMIND SHALL NOT BE LIABLE FOR:

Health & Safety:

❌ Any physical injuries or harm

❌ Any mental health issues or deterioration

❌ Any emotional distress, anxiety, or psychological harm

❌ Any medical conditions or health outcomes

❌ Any decisions made based on App content

❌ Any failure to seek appropriate medical care

❌ Any reliance on AI-generated content

❌ Any harm from breathing exercises or meditation

Financial:

❌ Loss of profits, revenue, or income

❌ Loss of business opportunities

❌ Financial losses of any kind

❌ Cost of substitute services

Data & Access:

❌ Loss of data, files, or content

❌ Corrupted or deleted information

❌ Service interruptions or unavailability

❌ Technical failures or malfunctions

Consequential Damages:

❌ Indirect damages

❌ Incidental damages

❌ Consequential damages

❌ Special damages

❌ Punitive damages

❌ Exemplary damages

Third-Party Issues:

❌ Actions or omissions of third-party service providers

❌ AI errors or failures

❌ Apple App Store issues

❌ Internet connectivity problems

❌ Device compatibility issues

9.3 AI-Specific Disclaimer

GioMind assumes NO LIABILITY whatsoever for:

• Any AI-generated content, responses, or suggestions

• Accuracy, completeness, or safety of AI outputs

• Decisions made based on AI interactions

• Misunderstandings or misinterpretations of AI content

• AI failures, errors, or unpredictable behavior

• Consequences of following or relying on AI advice

9.4 Essential Basis of Agreement

YOU ACKNOWLEDGE AND AGREE THAT:

• These liability limitations are ESSENTIAL to this Agreement

• GioMind would not provide the Service without these limitations

• You accept all risks associated with using the Service

• These limitations apply even if GioMind has been advised of potential damages

• These limitations apply even if any remedy fails of its essential purpose

9.5 Jurisdictional Variations

Some jurisdictions do not allow certain liability limitations. In such cases:

• Limitations apply to the maximum extent permitted by law

• If any limitation is found unenforceable, it shall be modified to the maximum extent permitted

• All other limitations remain in full force

9.6 Your Assumption of Risk

BY USING GIOMIND, YOU EXPRESSLY ASSUME ALL RISKS, INCLUDING BUT NOT LIMITED TO:

• Health risks from misinterpreting wellness content

• Risks from relying on AI-generated advice

• Technical risks from software or service failures

• Financial risks from subscription charges

• Any other risks inherent in using digital wellness services

10. DISCLAIMERS OF WARRANTIES

10.1 "AS IS" and "AS AVAILABLE" Service

10.2 Specific Warranty Disclaimers

GioMind EXPLICITLY DISCLAIMS all warranties, including but not limited to:

❌ MERCHANTABILITY – No warranty that the Service is fit for general use

❌ FITNESS FOR A PARTICULAR PURPOSE – No warranty the Service meets your needs

❌ NON-INFRINGEMENT – No warranty the Service doesn't infringe third-party rights

❌ TITLE – No warranty of ownership or clear title

❌ ACCURACY – No warranty that content is accurate or complete

❌ RELIABILITY – No warranty of consistent or reliable operation

❌ ERROR-FREE OPERATION – No warranty the Service is free from bugs or errors

❌ UNINTERRUPTED ACCESS – No warranty of continuous availability

❌ SECURITY – No warranty against hacking, data breaches, or unauthorized access

❌ COMPATIBILITY – No warranty of compatibility with your device or OS version

❌ RESULTS – No warranty of any specific outcomes or benefits

10.3 AI-Specific Disclaimers

Regarding AI-generated content:

❌ No warranty of accuracy, safety, or appropriateness

❌ No warranty of consistency across sessions

❌ No warranty that AI will meet your expectations

❌ No warranty that AI is free from bias or errors

❌ No warranty that AI responses are medically or psychologically sound

10.4 Third-Party Service Disclaimers

We make NO WARRANTIES regarding:

• OpenAI, Anthropic, or other AI providers

• Apple App Store or iOS platform

• Firebase, cloud storage, or hosting services

• Internet connectivity

• Your device or operating system

10.5 Forward-Looking Statements

Any statements about future features, updates, or improvements are:

• NOT guarantees or warranties

• Subject to change without notice

• Provided for informational purposes only

• Not legally binding commitments

11. SERVICE AVAILABILITY & TECHNICAL LIMITATIONS

11.1 No Guarantee of Availability

You understand and agree that:

• GioMind may be unavailable at any time without notice

• Service interruptions may occur due to maintenance, updates, or technical issues

• We do NOT guarantee 99%, 95%, or any specific uptime percentage

• Service may be limited or degraded during high traffic periods

11.2 Technical Limitations Beyond Our Control

The Service may be affected by factors outside our control, including:

• Apple iOS updates or restrictions

• Device-specific limitations (iPhone/iPad hardware or software)

• Low power mode or battery optimization settings

• Network connectivity issues (Wi-Fi, cellular data)

• Internet service provider problems

• Third-party service outages (OpenAI, Firebase, Anthropic, Cloudflare)

• Server maintenance or failures

• Cyber attacks, DDoS attacks, or security incidents

• Natural disasters or force majeure events

• Government actions, censorship, or regulatory requirements

11.3 Feature Limitations

You acknowledge that:

• Some features may not work on all iOS versions

• Some features may require specific device capabilities

• Notifications may be delayed or not delivered due to iOS restrictions

• Background audio may be interrupted by system limitations

• AI responses may be delayed during high usage periods

• Offline functionality may be limited or unavailable

• Data synchronization across devices may fail or be incomplete

11.4 Data Loss & Corruption Risks

GioMind is NOT responsible for:

❌ Lost journal entries, mood data, or user-generated content

❌ Progress tracking errors or inconsistencies

❌ Corrupted sessions or incomplete data saves

❌ Failed data backups or restoration issues

❌ iCloud synchronization problems

❌ Data conflicts between multiple devices

11.5 No Liability for Service Interruptions

WE ARE NOT LIABLE FOR:

• Any inability to access the Service

• Any delays, interruptions, or failures

• Any data loss resulting from service issues

• Any damages caused by unavailability

• Any alternative arrangements you must make

11.6 Right to Modify or Discontinue Service

We reserve the right at any time to:

• Modify features, functionality, or content

• Discontinue the Service entirely

• Remove or disable specific features

• Change technical requirements or compatibility

• Migrate to new platforms or technologies

NO REFUNDS will be provided if the Service is modified or discontinued.

12. SAFETY WARNINGS & USER RESPONSIBILITY

12.1 Attention & Focus Requirements

DO NOT USE GIOMIND when:

🚫 Driving any vehicle (car, motorcycle, bicycle, etc.)

🚫 Operating machinery or equipment

🚫 Cooking or using kitchen appliances

🚫 Crossing streets or walking in traffic

🚫 Supervising children or vulnerable individuals

🚫 In any situation requiring your full attention

🚫 When safety could be compromised by distraction

FAILURE TO FOLLOW THIS WARNING COULD RESULT IN SERIOUS INJURY OR DEATH.

12.2 Medical Contraindications

Breathing exercises and meditation may NOT be safe for individuals with:

• Respiratory conditions (asthma, COPD, etc.)
